A teacher in MI has been suspended for allegedly assaulting a sixth grade boy who was not standing for the Pledge of Allegiance.

Stone said another teacher the next day yelled at him to stand up.

'The district fully supports the right of each student to participate or not in the daily Pledge, ' Heitch said.

The Supreme Court ruled in the 1943 case of West Virginia State Board of Education v. Barnette that students can not be forced to say the Pledge of Allegiance in school.

A teacher was put on leave and is under investigation after he allegedly got physical with a student who refused to stand for the Pledge of Allegiance. "I say I don't stand for the pledge, she just glares at me and walks away", Stone said.

Chaney has not returned to school and his family was exploring whether to withdraw him from the school district, his father, Brian, said.

We think the action of the local authorities in compelling the flag salute and pledge transcends constitutional limitations on their power, and invades the sphere of intellect and spirit which it is the objective of the First Amendment to our Constitution to reserve from all official control. I have to make a stance for this, ' Chaney said. "And they should respect that", said dad Brian Chaney. Chaney said that sitting during the pledge is making a statement that he does not approve of what the American flag stands for or how his ancestors were treated.
