Govt to clarify stand on deportation of Rohingya Muslims in Supreme Court tomorrow

The Centre told the Supreme Court today Rohingya Muslims were illegal immigrants in India and their continued stay had "serious national security ramifications".

The government views members of the ethnic and religious minority as illegal immigrants from Bangladesh and not among the dozens of national ethnicities officially recognized by Myanmar.

The lawyer representing the Rohingya said the decision was discriminatory. It says the Rohingya can not use the 1951 Refugee Convention or the 1967 Protocol Relating to the Status of Refugees since India was not a signatory to either.

The Rohingya people - majority Muslims - have accused the Myanmar military and Buddhists of Rakhine of responding with a brutal campaign against them. It also said the government had intelligence indicating links between Rohingya refugees and Islamic State and other extremist groups.

Minister of State for Home Affairs Kiren Rijiju has stated it categorically that the government is looking for ways to deport over 40,000 Rohingyas living in the country illegally.

He asked the present dispensation to grant Rohingya Muslims the refugee status on the same lines India granted it to Tibetans, Afghans and Lankans.

In its affidavit to the Supreme Court, the government said that some of the Rohingyas with militant background were found to be very active in Jammu, Delhi, Hyderabad and Mewat.

Moreover, arrest of Al-Qaeda man in Delhi, who was tasked to recruit Rohingyas for terror activities in India, confirmed that Rohingas are a big threat on internal security.

"Even Tibetans, Afghans and Lankans who came from their respective countries fearing persecution were illegal the day they crossed over".

"We are still allowed to issue (visas on arrival) to diplomats, monks and nuns, but for tourists we have stopped giving arrival visas", she said. There are also some in Pakistan.

According to a United Nations estimate, over 3,79,000 Rohingya Muslims have fled the Rakhine state in northern Myanmar and entered Bangladesh since 25 August.

The hearing will continue next month. The government had told the parliament on August 9 that according to available data, more than 14,000 Rohingyas, registered with the UNHCR, were staying in India.
