The election commission, in its official results last month, said President Uhuru Kenyatta won the election with 54 per cent of the vote, while the veteran opposition leader Raila Odinga was deemed the runner-up with 44 per cent.

Furthermore, the IEBC was unable to explain what had happened to the results from over 11,000 polling stations which were required by law to be sent to tallying stations.

"Though the petitioner claimed various offences were committed by the issues of the first respondent, that is the IEBC (elections board), no evidence was placed before us to prove that allegation", Maraga said.

The Supreme Court ruled the electoral commission committed "irregularities".

The court annulled Kenyatta's victory in the August 8 election saying there were irregularities and illegalities.

On Tuesday, Kenyatta said the election "must be done within 60 days" in accordance with the constitution, adding that it should be conducted by Kenya's Independent Electoral and Boundaries Commission (IEBC). Those measures were ordered by the court of appeal a year ago to enhance accountability and reduce incidences of electoral fraud.

Its status as diplomatic, trade and security hub for East Africa means the court's ruling and the fresh election now scheduled for October 17 are being closely watched for any sign of instability or violence. Foreign diplomats have also been subjected to "hate speech and incitement", they said.

Maraga ordered the IEBC to "put in place a complementary system" to be used in the event that technology fails in the new election due on October 17.

On Monday, the French technology company supporting the election said it would be almost impossible to be ready for that date.

"Although Kenyans turned up in large numbers to vote on election day, after the voting, everything went opaque".

Supporters of Mr Kenyatta are unlikely to be persuaded by the ruling.

The judiciary also reported having received threats and accused the police of not providing sufficient protection, which the police have denied.

While the judgement was being read out, police fired tear gas outside the Supreme Court to disperse opposition supporters who had gathered to support Mr Odinga.
