Federal District Court Stops Transgender Military Ban in Doe v

The judge, Colleen Kollar-Kotelly, issued a preliminary injunction on Monday halting two portions of Trump's presidential memorandum issued in late August, including his reinstatement of the ban on transgender service members that was in place before June 2016.

Today, the U.S. District Court for the District of Columbia ruled in favor of the plaintiffs and enjoined the transgender military ban, the discriminatory policy challenged in Doe v. Trump, the first case filed against President Trump's transgender military ban.

"Thousands of transgender troops now serve in the USA military and thousands more have served and given their lives for the country throughout our history", the commission said in a statement. Transgender individuals were to be allowed to enlist in the military in June 2017, a timeline initially delayed under the Trump administration to January 1, 2018. Under President Barack Obama, that policy was changed to allow transgender service members.

Mr Trump signed a memorandum in August that directed the United States military not to accept transgender men and women as recruits and halted the use of government funds for sex-reassignment surgeries for active-duty personnel unless the process is already under way.

But the plaintiffs did not establish that they would by harmed by the ban on funds for gender reassignment surgery, Kollar-Kotelly ruled.

GLBTQ Legal Advocates & Defenders, or GLAD, issued a statement about the ruling in favor of plaintiffs from their organization and the National Center for Lesbian Rights.

The Trump administration had asked the court to dismiss the lawsuit; Kollar-Kotelly refused to do so, and Minter said it's possible the case will go to trial. "Rather than be able to count on a career in military service, as they have done, they'd be facing discharge".

The judge wrote that her ruling was based, among other things, on "the sheer breadth of the exclusion ordered by the directives, (and) the fact that the reasons given for them do not appear to be supported by any facts".

"The federal courts are recognizing what everyone already knows to be true: President Trump's impulsive decision to ban on transgender people from serving in the military service was blatantly unconstitutional", said Joshua Block, senior staff attorney with the ACLU's LGBT & HIV Project. There is no definite figure for how many transgender people are now on active duty, but estimates range from about 2,500 to 15,500.
