Supreme Court dismisses case against Trump's expired travel ban

The Supreme Court on Tuesday scrapped one of the legal challenges to President Trump's travel ban, saying the new policy the White House announced late last month supersedes the older policy.

Lawyers representing Hawaii have asked a judge to stop the Trump administration from enforcing the latest version of its travel ban.

Though Trump's Muslim ban has been revised several times, it still contains two major parts. Although the country as a whole "has improved its capability and ability to assess whether foreign nationals attempting to enter the United States pose a security or safety threat", he indicated, travel restrictions are still necessary for these eight countries.

On Tuesday, the Supreme Court quashed the appeal decision on the Maryland ruling, with the suspension in Hawaii still valid but its days likely numbered.

Mr. Trump last month revised the six-country travel ban first issued in March.

Unlike the other bans, it treats some countries and types of travelers, such as students or tourists, differently than others.

The ban's challengers argued that the case against the last version should go forward because numerous same travelers and their families are adversely affected - not just for 90 days, but indefinitely.

The collision raised concerns after a series of terror attacks this year in London involving vehicles ramming pedestrians. Britain is on its second-highest security alert level, meaning that an attack by militants is considered highly likely.

Monday's order deals with just one of the two cases the Court considered in June. Succeeding the habitual practice in such cases, The judgment is therefore abdicated and the case is adjourned to the United States Court of Appeals for the Fourth Circuit with directives to disperse as moot the provocation.

The justices did not say what they will do with another challenge lodged by Hawaii, which came up through the 9th Circuit, and which covered a broader set of objections than the 4th Circuit case.

The court had originally planned to hear two cases challenging the order on October 10, but cancelled arguments after Trump issued new, targeted restrictions on travel from eight countries - Chad, North Korea, Venezuela, Iran, Libya, Syria, Yemen and Somalia.

Meanwhile Hawaii, the plaintiff in the case that's still alive before the justices, filed an updated complaint in federal district court challenging the revised policy.

"Because that provision of the order "expired by its own terms" on September 24, 2017, the appeal no longer presents a "live case or controversy", the Supreme Court summary said.

Dismissing the cases would allow the court to avoid ruling on hard legal issues, at least for a while.
