Austria becomes latest European country to legalise same-sex marriage

Bulgaria Austria Court Legalises Same Sex Marriage From Start of 2019

Same-sex couples will be allowed to marry in Austria from 2019, the country's supreme court ruled on Tuesday and said a law to the contrary violated the principle of non-discrimination.

Restrictions on same-sex marriage will expire on December 31, 2018.

"Because the separation into two legal institutions expresses that people with same-sex sexual orientation are not the same people with different sexual orientation".

Last month, Australia became the 26th nation to follow suit after the country voted overwhelming in favour of legalising same-sex marriage.

Thus, they ruled that and the country must remove that gender-biased phrase and allow marriage equality by 2019 unless the Austrian Parliament decides to pass legislation legalizing same-sex marriages before then. Yes!

Helmut Graupner, a lawyer for the two women who brought the case, wrote in a Facebook post that "today is a truly historic day".

The Austrian People's Party, which is working to form a new government after elections in October, said that it would accept the ruling.

"We are very happy", said The Homosexual Initiative Vienna (HOSI) chairman Christian Hoegl.

Many western European countries have introduced marriage equality.

"The resulting discriminatory effect is seen in the fact that. people living in same-sex partnerships have to disclose their sexual orientation even in situations, in which it is not and must not be relevant, and. are highly likely to be discriminated against", the court said in its ruling. The country's courts have now ruled that definition cannot remain and have ordered that marriage be made available to all couples. Under previous law, gay couples could join together in civil unions and were afforded all the legal rights of married heterosexual couples, but could not officially marry.
