FBI Says There Is No Evidence Border Patrol Agent Murdered

Agent Rogelio “Roger” Martinez 36 suffered serious injuries the night of Nov. 18 while patrolling outside of Van Horn

The mystery surrounding the death of US Border Patrol agent Rogelio "Roger" Martinez is nowhere close to being solved. Agent Martinez and his partner were on patrol near Van Horn Texas about 120 miles east of El Paso.

The incident happened last November. Martinez's unnamed partner was also found with serious injuries but survived and remains hospitalized. "The dispatcher also recorded in a Border Patrol log, "[He] thinks they (both agents) ran into a culvert". He died in a hospital the following day. "As part of this effort, the FBI has investigated multiple theories, including whether the Border Patrol Agents were ambushed or attacked or whether their injuries were as a result of an accident or any other relevant criminal activity".

Then late Wednesday, Emmerson Buie Jr. special agent in charge of the FBI's El Paso office, which led the investigation, released a blockbuster statement: "To date none of the more than 650 interviews completed, locations searched, or evidence collected and analyzed have produced evidence that would support the existence of a scuffle, altercation, or attack on November 18, 2017". "Our view is he was attacked", Cabrera told CNN.

The FBI says they are continuing to investigate Agent Martinez's death as a high priority and will pursue any new and relevant tips.

"From the beginning we were radioed to assist in the incident as an injury, not an assault", he said.

Martinez and Garland were found injured on November 18 in a rock-strewn culvert that runs under Interstate 10 at about 11:20 p.m.

A Customs and Border Protection spokesperson declined to comment on the case. He had a broken clavicle and several broken ribs, but the El Paso County Medical Examiner determined it was the trauma to his head that was the determining cause of his death.

"The evidence also shows that the other agent fell approximately 22 feet away from where Agent Martinez fell, landing on his back and sustaining significant injuries to his back and skull", the memo said.
