Facebook faces Class Action suit over facial recognition on photos

Facebook will face a class action lawsuit in the U.S. over its use of facial recognition technology, a federal judge has ruled. The class action says that this breaches IL state law.

As part of initial legal procedure, the class of people filing this lawsuit has been legally defined as Facebook users "in IL for whom Facebook created and stored a face template after June 7, 2011". Illinois' Biometric Information Privacy Act made it illegal to collect and store faceprints without obtaining informed written consent.

Facebook only uses its face-scanning tech in certain countries.

"Facebook should suspend further deployment of facial recognition pending the outcome of the FTC investigation", EPIC President Marc Rotenberg said.

Facebook's facial recognition technology, which it uses to recognise users in photos and identify impersonators, has not been available in the European Union since 2012 after being accused of violating privacy laws for not obtaining users' consent.

Lawsuit challenges the social-network giant over its gathering of facial recognition data on photos without the consent of users.

Carolina Milanesi, the author of the study, found that when asked on how Facebook can regain user trust, rather than getting more tools and settings, a lot of the users are asking for the company's transparency.

The lawsuit was originally filed in mid-2015 but has been repeatedly kicked down the road with Facebook attempting to have the case dismissed.

Over the last few weeks, Facebook has drawn intense criticism from users and governments globally over a number of issues, ranging from false news on the platform to information of over 80 million users being mined by data analytics and political consulting firm, Cambridge Analytica.

"We are beginning small and know it is important to learn from this test and listen to our community as we continue to update ways for people to understand what might be false news in their News Feed", it said.

Like many features which bear privacy implications, the tag suggestion is enabled by default-a move that upset some watchdogs, who believe any function providing access to data should be opt-in.
