BJP says PIL in Loya case was for 'Congress' benefit not in 'public interest'

The Supreme Court on Thursday dismissed petitions seeking a SIT probe into the death of Judge B.H. Loya, who was conducting a trial in the killing of gangster Sohrabuddin Sheikh in Gujarat in which now BJP President Amit Shah was an accused.

Referring to senior counsel Dushyant Dave's argument to the extent of insinuating that one individual (BJP president Amit Shah) is controlling the entire judiciary in Maharashtra and elsewhere, the bench said such allegations have the propensity of endangering the credibility of other institutions and undermining public faith in democracy and the rule of law. "The truth has its own way of catching up with people like him", he said on Twitter.

In a hard-hitting order, a three-judge Bench trashed every charge made in the petitions filed by Congress spokesperson Tehseen Poonawala, lawyer associations, a journalist, and individual citizens, but stopped short of initiating criminal contempt against the lawyers who represented them despite holding that the petitions scandalised the judiciary by levelling false charges. He also slammed Congress party by saying that it wanted to create an atmosphere of fear in the country.

He added that the original petitioner was the Bombay Advocates Association. "This is the lowest point in Rahul Gandhi's political career", Patra said.

He also stressed that the Congress was not among the petitioners seeking a probe into the judge's death and recalled that the party had instead approached the people's court and approached President Ram Nath Kovind along with 14 other opposition parties. Addressing the media, Congress leader Randeep S Surjewala said, "The verdict marks a sad day in India's history. No one, without an investigation, can decide whether death is natural or not", he said.

"The Indian Computer Emergency Response Team (CERT-In) has advised the Supreme Court on the restoration of the website". We reject and condemn the malicious attempts of the BJP to misinterpret the judgement for finger pointing, he said.

Justice Chandrachud, writing the judgment for the Bench, said, "We must lean in favour of the version of the four judicial officers unless strong and indisputable circumstances are shown to doubt their credibility".
