ZTE to fight U.S. export ban, threatens legal action

Chinese phone maker ZTE is unable to access US components for now

Last year, ZTE was fined $1.19 billion by the USA for supplying goods and services to Iran and North Korea.

On Friday, ZTE Corporation said that the ban implemented by USA authorities on sale of software and equipment was unfair and the survival of the company will be under question if this ban is not lifted. USA companies are barred from selling technology to state-owned ZTE for seven years. The company also promised that it will protect its interest by all legal means. While the new ban is limited to ZTE at this point, this countermove by China could stir the pot a bit more when it comes to its relations with the U.S. It may also decide to take non-specific "judicial measures" to defend its position - if a lawsuit is filed, the company may attempt an injunction at the Denial Order to keep parts supplies from the United States flowing.

The company said that it had established a team to monitor export compliance.

"The Denial Order will not only severely impact the survival and development of ZTE, but will also cause damages to all partners of ZTE including a large number of USA companies", it said in a press release issued today. "Within ZTE, compliance is regarded as the foundation and bottom-line of the company's operation", it said. Meanwhile, while speaking to Reuters, a senior Commerce Department official said that this ban will not be lifted.

The Commerce Ministry spokesman's comment was the first Chinese statement about the US chipmaker's proposed acquisition since a trade dispute blew up between Beijing and President Donald Trump over technology policy.

"As for remedial measures already proposed by Qualcomm, the market test conducted by the investigating agency found Qualcomm's plan has difficulty resolving the related market competition problems", said the spokesman, Gao Feng, at a regular ministry briefing.
