FBI Has Suspect in Damaging CIA Leak of Spying Code

The New York Times reports that the suspect in question is a 29-year-old former C.I.A. software engineer named Joshua A. Schulte.

The disclosure constituted one of the largest breaches of classified.

Last week, Schulte's lawyer, Sabrina Shroff, told a court that a deadline should be set for the government to file charges on the allegation that he was behind the Central Intelligence Agency leaks.

The Department of Justice notes that a first-time offender convicted of distribution of child pornography faces a statutory minimum sentence of 5-20 years, which can be scaled upward depending on the nature of the material. According to an FBI affidavit, investigators obtained passwords from Schulte's phone and decrypted a 54 GB file stored on a virtual machine that allegedly contained 10,000 offensive images and videos.

Authorities appeared to piece together several bits of information to come up with the theory Schulte is responsible for the leak.

Prosecutors said they plan to file a new indictment by July. But that failed to provide the evidence that prosecutors needed to indict Schulte with illegally giving the information to WikiLeaks.

But at Schulte's January detention hearing, Kaplan signaled his and his client's frustration with the investigation.

The child pornography charges, according to the NYT, stem from material investigators found on a server Schulte created as a business in 2009 while he was a student at the University of Texas. Kaplan argued that Schulte's roommate was actually accessing the account, but the government argued that such a course of action was still forbidden. But the prosecutor, Matthew Laroche, an assistant US attorney in the Southern District of NY, said that the government has not brought an indictment, that the investigation "is ongoing" and that Schulte "remains a target of that investigation", according to a court transcript of the January 8 hearing that escaped public notice at the time. Part of the investigation "is analyzing whether and to what extent TOR was used in transmitting classified information", Laroche said in court to Judge Paul Crotty.
