Trump administration to rollback Obama-era college admission guidelines on race

The Department of Justice announced Tuesday it is ditching 24 Obama-era guidance documents, including one granting work protections to refugees and asylum seekers.

Across the country Tuesday the news received mixed reviews.

The new policy dramatically departs from the stance of the Obama administration, which on multiple occasions said schools could consider race in admissions decisions and should do so to foster diversity.

"Institutions are not required to implement race-neutral approaches if, in their judgment, the approaches would be unworkable", the guidance said. One, it has to show there is that compelling interest, achieve diversity or remedy past discrimination, and it has to be - the use of race has to be narrowly tailored to achieve that interest, it can't go any farther than necessary.

The reversal doesn't change current USA law on affirmative action and doesn't affect how schools choose to operate within the confines of current Supreme Court precedent, but changes guidelines to more closely resemble a Bush-era document encouraging "race-neutral" methods of admitting students to elementary and secondary schools. Such guidance does not have the force of law, but schools could use it to help defend themselves against lawsuits over their admission policies.

Civil liberties groups decried the move, saying it went against decades of court rulings that permit colleges and universities to take race into account.

The guidelines, put in place under President Barack Obama in 2011 and 2016, presented legal recommendations that Trump administration officials contend "mislead schools to believe that legal forms of affirmative action are simpler to achieve than the law allows", the Journal reported, citing two people familiar with the plans.

Eight states already prohibit the use of information on race in public college admissions: Arizona, California, Florida, Michigan, Nebraska, New Hampshire, Oklahoma and Washington.

Instead, the documents provided interpretations of the law and offered suggestions to schools. "It is more evidence that the Trump administration is skeptical about race-based decision-making in admissions and in other contexts". However, the government would uphold it as official opinion, and schools could face lawsuits from the Justice Department for maintaining affirmative action practices. Justice Antonin Scalia died after the court heard arguments in the case but before the decision was handed down. In addition to those guidances, the Justice Department pulled 17 other policy directives it deemed "unnecessary, outdated, inconsistent with existing law, or otherwise improper".
