Immigrant children who were separated from family have been reunited

Another federal judge is considering a government motion to let parents choose between staying with their children in long-term ICE detention or voluntarily giving their children to HHS while they await legal proceedings, the New York Times reported.

In court earlier this week, officials said it is possible that one young child held in federal custody for more than a year is a US citizen.

The ACLU, which is representing the families, argued in a court filing that the government didn't comply with the court order ― not only because it missed the deadline to reunite many parents and children but also because of a lack of information sharing.

The Department of Health and Human Services, which has custody of the minors, and the Department of Homeland Security, which has custody of most of the adults, said in joint statements that they reunited 57 children with their parents.

"Our message has been clear all along: Do not risk your own life or the life of your child by attempting to enter the United States illegally", the statement said. "Apply lawfully and wait your turn".

Disqualifications include 22 children who were not reunified due to concerns that they would not be safe with the adult with whom they crossed the border.

Sabraw had said earlier this week in court that he expected the government to be able to reunite at least 63 children with their parents by the end of Tuesday. One adult had a falsified birth certificate, one was accused of abusing the child who had been brought across the border, one was being treated for "a communicable disease" and one had planned to house their child with an adult who had been charged with child sexual abuse.

Another two dozen were held because of problems with a parent, including 12 who were deported, nine in the custody of the US Marshals Service, two in state jails and one who can not be located.

The request by the American Civil Liberties Union follows a chaotic week for USA immigration officials, who failed to meet a court-ordered deadline on Tuesday for reuniting children under the age of five. Additionally, the location of one child's parent had not been known for over a year.

Sabraw had earlier ordered the government to forgo DNA testing of all adults and to skip background and fingerprint checks of all residents in the homes where the children will live, unless there was a safety concern.

But even though the government has made this argument in public and in court, the judge in the case has maintained that because the government was the one to separate these families, it has an "obligation" to reunite them swiftly.

The Trump administration's "zero-tolerance" policy to prosecute all adults crossing the border illegally resulted in the separation of thousands of children from their parents after entering the United States, though this case was filed long before that policy and affects nearly all families separated at the border still in government custody.

A federal consent decree requires the government to release children from family detention facilities within 20 days.

Is the "zero-tolerance" policy over?

Of the deported parents, officials said they had chosen to leave their children behind. Physicians and others blasted the policy and warned about lasting psychological damage to children and parents. Customs and Border Patrol also stopped referring all parents from criminal prosecution, essentially returning the situation at the border to the previous status quo.

The ACLU asked for the government to provide a daily report of reunified families to the court starting next week and for additional details to prevent the government from missing future deadlines.
