It would also give Democratic Senators in red states an excuse for not taking a position on the Kavanaugh nomination before they are up for reelection in early November.

Republicans asked the National Archives and Records Administration last week if it could release thousands of documents relating to Kavanaugh's time in the White House Counsel's Office for Bush by August 15. Grassley did not request any additional documents pertaining to Kavanaugh's time as Bush's staff secretary. Manchin's remarks mean he did not commit to voting for or against Kavanaugh ahead of the confirmation hearing that could take place as soon as September, with the goal of replacing retiring Supreme Court Justice Anthony Kennedy before the next court session begins on October 1.

Notably, Grassley neglected to ask NARA for records from Kavanaugh's time as staff secretary, a choice committee Democrats say ignores most of the nominee's work in the Bush White House. Bush. Instead, the GOP has only requested documents from his time in the White House counsel's office from 2001 to 2003.

Senate Republicans have yet to schedule a confirmation hearing for Kavanaugh. They are particularly interested in whether Kavanaugh authored or edited documents relating to the Bush administration's controversial enhanced interrogation and warrantless wiretapping programs.

Sen. Chuck Schumer objects that the Bush records team might withhold documents the Archives would be willing to produce.

And even if one is concerned about this possibility, one solution would be to have the Archives folks review any documents the Bush team says should be withheld.

Republicans have been hesitant to request those records, however, and have accused Democrats of engaging in stalling tactics. Orrin Hatch (R-Utah) said at a Capitol Hill press conference on Thursday.

Democrats wrote to the National Archives requesting a broad set of the documents, using a letter with almost the same language that was sent by both parties in 2010 seeking documentation about Obama's nominee Elena Kagan. He further complained about what he called "dumbass" partisanship over Kavanaugh's nomination.
